We have conducted pre-trial research, helped prepare witnesses, assisted with theme development and selected juries in over 170 contract cases.
In our experience, the facts do not speak for themselves in most complex commercial and business torts cases. The facts in a particular case may seem to clearly favor one side, but in unraveling the order of events and the choices each party made along the way, often the case is not closed nor the verdict a ‘done deal’. AKT Development v. Charles Somers, et al.
This case included claims of fraud, breach of contract, and fiduciary duty in a real estate joint venture brought by a well-known Sacramento businessman and philanthropist. With our assistance, the trial resulted in a defense verdict.
General Nanotechnology v Lawrence Livermore National Laboratory
The plaintiff claimed that our client breached a nondisclosure agreement and used confidential information in awarding a contract to a foreign company. After one hour of deliberations, the Alameda jury returned a unanimous verdict for the defendant.
Nevada State Bank v. Circle Bar N Ranch LLC
Our client loaned the defendant millions of dollars for a milk processing plant. When the plant failed, the bank put the loan into foreclosure, and sued the defendant. The local judge told the plaintiffs it would be impossible to win against one of the largest employers in Lyon County, NV. To the surprise of the judge, the jury found for our clients.
Wimar Tahoe Corporation vs. Park Cattle Company
This was a complicated, fact-intensive dispute involving a lease agreement for a casino, and failure to maintain the property as a “First Class “and “Competitive” facility. We helped Park Cattle prevail on its cross complaint, regain control of its property and obtain a significant award.
Cupertino Square v. Gramercy Warehouse Funding I, LLC
The plaintiff obtained a $100 million loan for the remodeling of a shopping center. After the center failed, they sued the lender in an attempt to invalidate the loan agreement. The jury returned a verdict in our client’s favor and awarded damages in their countersuit.
