Recently, our firm has been brought in to assist in the defense of serial litigation emerging out of a state class action tobacco case, in which the class was decertified on appeal. We have also consulted with defense teams on almost all major consolidated asbestos trials throughout the country, including several hundred individual cases that have gone to trial.

In serial litigation, it is critical to get systematic feedback from jurors. We regularly provide ongoing insight from jurors by conducting post-trial juror interviews and shadow juries, as well as multiple focus groups and mock trials. We use the wealth of information we gather to create strategic refinements and real-time responses to changes in plaintiffs’ approach.

In recent years, we have also helped our clients obtain successful trial outcomes in cases involving outboard motors (design defect, Nevada State Court); FEMA trailers used in Hurricane Katrina (dangerous condition and failure to warn, Louisiana Federal Court), mortars used by the military (design defect, Hawaii State Court); and ovens (design defect, Iowa Federal Court).
